By accessing or using our website and services (collectively, the "Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). You must be at least 16 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement.

3. Account Registration

Our Content: All content provided by us, including text, graphics, logos, and software, is our property or the property of our licensors and is protected by intellectual property laws.

6. Decentralized Assets and Cryptocurrency Transactions

Our Services may include features that allow you to interact with blockchain-based assets, including minting and upgrading Treasure Key NFTs and transacting with tokens such as $AVAX, $SMRTR, and $TRESR. You acknowledge and agree that:

• Assumption of Risk: Engaging with decentralized assets involves significant risks, including market volatility and potential loss of digital assets. You assume all risks associated with such transactions.
• No Liability: We provide access to decentralized asset functionalities "as is" and disclaim all warranties related to these features. We are not responsible for any losses or damages arising from your use of decentralized assets through our Services.

7. Commissions, Discounts, and Coupons

Treasure Key NFTs: By minting and upgrading a Treasure Key NFT, you may be eligible for certain discounts and commissions based on your key level.

Coupon Usage: By default, your products are included in promotional campaigns that may involve the use of coupons. If a coupon is applied to a sale, the commission paid out on that product will be reduced accordingly. You cannot simultaneously use a discount and receive a commission on the same product.

Opting Out of Promotions: When available, you will have the option to opt out of promotional campaigns through your account settings. Until such options are provided and exercised, your products will be included in promotions by default.

Legal Documentation: We reserve the right to request legal documentation as a prerequisite for issuing any commission payouts.

8. Termination

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.

9. Disclaimers and Limitation of Liability

As-Is Basis: Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied.

Limitation of Liability: To the fullest extent permitted by law, NFTREASURE dba TRESR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

You agree to indemnify and hold harmless NFTREASURE dba TRESR, its affiliates, officers, agents, and employees from any claim or demand made by any third party.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
